At AliMed, the privacy of our users and visitors are very important to us. The purpose of this Privacy Policy is to provide you with a description of the types of personal information we collect about you when you use our applications, websites, content, products, and services and how we use that information. This Privacy Policy only applies to personal information collected about you while you are accessing or using the Service. By registering to use the Service or otherwise accessing the Service, you accept this Privacy Policy and certify that you have reviewed it. In this document, references to “AliMed”, “we” “us” or “our” means AliMed, “you” or “your” means the users of or visitors to our website and Service, “Privacy Policy” means this privacy policy, and “Service” means our websites and subdomains, commerce platforms, applications, plugins and the content, products, and services available through those means. “Personal information” or “personal data” means personally identifiable information, personal information, or personal data, as defined in applicable laws. “Terms” means our Terms and Conditions.

1.    HOW DO WE COLLECT INFORMATION?
We collect and store information that you voluntarily provide to us as well as data related to your use of the Service. Below is a more specific list of the personal information we collect and how we use it with your consent. You may be asked additional questions regarding items on this list to ensure we have your consent to collect and use your personal information for specific purposes.

A.    Information You Provide

(a)    Newsletter/Email Waitlist: When you voluntarily provide us with your email address, we collect your email address from which your identity is or may be discernible.

(b)    Account Creation: If you establish an account on the Service, we may collect your name, email address, billing address, and other information to support your use of the Service.

(c)    Payment and Transactional Data. When you pay for use of certain areas or features of the Services, if applicable, our payment processor or the applicable app store collects the financial information required to process your payments, including name, payment card information, bank account number, billing information. In addition to this Privacy Policy and our Terms, information related to your payments or purchases is also processed according to such app store’s services agreement and privacy policy.

(d)    Support: If you send messages through our contact form, or provide information to our sales or support teams, we collect your name, email address, and other information to reasonably provide the support you have requested.

(e)    Social Networking Service Data: We have pages on social media sites like our Facebook, Instagram, X (Twitter), Tik Tok, LinkedIn, or Facebook profiles (“Social Media Pages”). When you interact with our Social Media Pages, we will collect personal data that you elect to provide to us, such as your contact details. In addition, the companies that host our Social Media Pages may provide us with aggregate information and analytics regarding the use of our Social Media Pages.

(f)    Telephone Number/SMS Message. When you voluntarily provide us with your telephone number and/or opt into our SMS messaging system, we collect your email address from which your identity is or may be discernible.

(g)    Single Sign-On. If you access the Services or create an account using a third-party service, such as a social networking service like Meta or Google, we will collect personal information that you elect to provide to us, such as your name and contact details.

(h)    Surveys and User Research: We may send you surveys or contact you with questions to provide us with feedback on our Service. We collect any responses that you provide. Participation in surveys or research tasks is elective and does not affect your access to the Service.

(i)    Sweepstakes, Contests or Other Promotions. When you participate in or win a sweepstakes, contest, or other promotion we may collect Personal Information, including contact or tax information if required by law.

Note regarding Sensitive Personal Information

Unless we specifically request or invite it, we ask that you not send us, and you not disclose, any sensitive personal information (e.g., social security numbers, information related to racial or ethnic origin, political opinions, religion or philosophical beliefs, health, sex life or sexual orientation, criminal background, or trade union membership, or biometric or genetic data) on or through the Service or otherwise to us.

B.    Information Third Parties Provide About You

We may receive information about you from app stores from where you download certain portions of the Service, your employer or organization, business contacts, friends and other third parties, such as when they submit information to us about you or when they post content on the Service. Additionally, we may supplement the information we collect with records from third parties for a variety of purposes, including to help us correct or supplement our records, enhance our ability to serve you, to help prevent or detect fraud, to tailor our content and ads to you, and to offer you opportunities that may be of interest to you.

To the extent we combine information we receive from those sources with your personal data, the combined information will be treated as personal data under this Privacy Policy, unless we have disclosed otherwise. In no other circumstances will this Privacy Policy apply to information we receive about you from third parties.

C.    Automatically Collected Information

In addition, we may automatically collect certain information and analytical data related to your use of the Service. Automatically collected information about you may include the date and time of your visit, your location, information about your usage of, and interaction with, our software, the Service, the IP address of your computer or mobile device, your computer or mobile device browser information, the internet address that you visited prior to and after reaching the Service, the name of the domain and host you used to access the internet, the type of mobile device you use, your mobile device’s unique device ID, the features of the Service which you accessed, and correspondences between you and us. This data is not associated with your personal information. We may also use cookies (see “WHAT ARE COOKIES AND HOW DO WE USE THEM?” below), pixels, clear gifs, and web beacons to track your interaction with the Service, and to customize our Service for you.

We will respect your choices relating to online tracking, whether you choose to reject individual cookies or set your web browser to reject cookies and other tracking technology. However, refusing a cookie may, in some cases, preclude you from using, or negatively impact the display or function of, the Service or certain areas or features of the Service.

D.    Third Party Services & Partners

To the extent you use a third-party service to interact with our Service, such as our credit card payment processor, integration with social media, message boards, or other communications platforms, and through our business, personal data will be collected by those providers and governed by their respective privacy policies.

To the extent we combine information we receive from those sources with your personal data, the combined information will be treated as personal data under this Privacy Policy, unless we have disclosed otherwise. In no other circumstances will this Privacy Policy apply to information we receive about you from third parties.

E.    Interactions with Third-Party Sites

The Service may include functionality that allows certain kinds of interactions between the Service and your account on a third-party site or application. The use of this functionality may involve the third-party providing information to us. If we offer and you choose to use this functionality, the third-party service may send personal data about you to us. If so, we will treat it as personal data under this Privacy Policy since we are collecting it because of your interaction on our Service.

In addition, we may provide third-party sites’ interfaces or links on the Service to facilitate sending a communication from the Service. For example, we may use third parties to facilitate emails, advertising, or postings. These third parties may retain any information used or provided in any such communications and these third parties’ practices are not subject to our Privacy Policy. We may not control or have access to your communications with or through these third parties, and we are not responsible for their privacy practices. You should review the applicable third-party privacy policies before using such tools.

2.    HOW DO WE USE INFORMATION WE COLLECT?
Our primary purpose in collecting information is to provide you the Service. When we collect and use your personal data, we do so based on a number of legal bases, including the following:

  • We need to fulfill a contractual obligation we have to you;
  • You have consented to us collecting and using that data;
  • Our legitimate interests in providing and offering the services available on our Service; and
  • The limited situations where required to do so by law or legal order.

When we collect or use your personal data out of a contractual obligation to you, it means that we need such personal information to fulfill an order you have placed or to provide Services you have purchased or access to the Service.

You consent for us to collect and use your personal data after you request to be contacted by us, sign up for the Service, or when you consent to our collection of your analytics and automated data collection.

We may use the information you provide to us for other purposes as follows:

(a)    Support the Service: We may use the information you provide us to provide any customer support you request, including troubleshooting problems, and monitor such requests, and to inform you about updates to the Service.

(b)    Improve the Service: We may use the information you provide us to customize, measure, and improve the Service, including through data analysis, testing, research, statistical and survey processes.

(c)    Enforce Rights: We may use the information you provide us to enforce your and our rights (including payment for the Service) and to protect you against fraud.

(d)    Analysis of Personal Information: We may analyze your personal information to provide personalized services to better understand you, so that we can personalize our interactions with you and provide you with information and/or offers tailored to your interests; to better understand your preferences so that we can deliver content via the Service that we believe will be relevant and interesting to you.

(e)    Marketing Purposes: We occasionally may contact you about new product and features. You may remove your name from our mailing lists to stop receiving these emails. We also may share your email address with our partners and affiliates.

3.    CAN WE USE DE-IDENTIFIED INFORMATION?

In addition to the uses of personal information above, we may remove the personally identifiable parts of your information to create de-identified forms (“De-identified Information”). De-identified Information may be compiled with other data in aggregated forms. We may use this De-identified Information in the following ways:

(a)    Disclosure for Business Purposes: We may also license, sell or otherwise share De-identified Information with clients, partners, investors and contractors for any purposes related to our business practices.

(b)    Service Improvement: We may use De-identified Information for product improvement including to the Service as well as share it with third parties to evaluate their products or services.

(c)    Research: We may use De-identified Information for research whether scientific, marketing, or business in nature. This research may be made public through publication such as within a scientific journal.

4.    HOW DO WE SHARE THE INFORMATION WE COLLECT?

We do not sell, rent, trade or otherwise transfer personal information to third parties who are not our affiliates or business partners without your consent to do so. We may, however, disclose personal information:

(a)    to our affiliated companies - including brand partners, strategic alliance affiliates, carriers, third party service providers and/or agents, as reasonably necessary to provide you with the Service you have requested;

(b)    as required by law or legal process;

(c)    in response to lawful requests for information by governmental agencies, such as law enforcement authorities, authorized to request such information;

(d)    to enforce our contractual agreements, including investigation of potential violations thereof;

(e)    to help detect and prevent potentially illegal acts and violations of our policies and to otherwise protect our interests;

(f)    to help detect and prevent harm to persons or property or otherwise to protect public safety;

(g)    to third parties that perform functions on our behalf, including, but not limited to, third parties that host or operate our Service, analyze data, perform email list management services, provide customer service, or provide public relations and marketing services;

(h)    and to vendors of products and services that are offered through the Service.

We are not limited in our use of De-identified Information or non-identifiable aggregate information about our users (such as the number of users on the Service and the geographic distribution of our users). As such, in no way to limit the foregoing, we may share aggregate (non-personally identifiable) information with certain third parties such as advertisers, industry organizations, and prospective affiliates.

We do not enable third parties, except for certain of our subcontractors, to collect information directly from users while they interact with the Service. Our subcontractors only collect and use information at our direction and only to support the functioning of the Service and to perform analytics. Our subcontractors may not share this information with third parties.

As with any other business, it is possible that in the future we could sell or buy subsidiaries or business units. In any such transaction, as well in the event all or substantially all of our assets are acquired by a third party, personal information of our users will generally be one of the transferred assets. We reserve the right to include your personal information, collected as an asset, in any such transfer to a third party.

Information collected by or sent to us may be stored and processed in any country in which we and our affiliates, subsidiaries, or service providers maintain facilities. We reserve the right to transfer your personal information outside of the country where you reside and/or from which you use our Service. By using our Service, you consent to any such transfer of information outside of your country.

5.    HOW LONG IS YOUR PERSONAL INFORMATION KEPT BY US?

We will retain your personal information for as long as reasonably necessary to: provide the use of our Service; invoice charges and to maintain records until invoices cannot be lawfully challenged and legal proceedings may no longer be pursued; communicate with you regarding other services that we offer; comply with applicable laws, regulations, and court orders; enforce our contractual agreements; or fulfill any of the purposes for which we collected the personal information as listed in this Privacy Policy.

If you close your account, we may still retain certain information associated with your account for analytical purposes and recordkeeping integrity, as well as to prevent fraud, collect any fees owed, enforce our Terms, take actions we deem necessary to protect the integrity of our Service or our users, or take other actions otherwise permitted by law. 

Deactivating your account does not automatically delete your account or content from our database, but regardless of any retention policy we will take commercially reasonable efforts to enable you to delete your personal information from our database upon request. However, if certain information has already been provided to third parties, retention of that information will be subject to those third parties’ policies. Additionally, if you have provided your information to third party services or otherwise made it available to the public, you may not be able to remove or edit your information from some internet databases.

6.    WHAT ARE COOKIES AND HOW DO WE USE THEM?

Cookies are small text files stored on a user’s hard drive which contain certain data about the user. IP addresses are the unique code assigned to your computer as connected to the Internet. We use third-party “cookie” technology to track IP addresses only to obtain data about how visitors use our Sites to provide them with the best possible personalized online experience. To do this we and the third parties described in this policy may use third-party cookies and other tracking technologies to keep track of the type of browser (e.g., Internet Explorer, Chrome) and operating system (e.g., Windows, Macintosh) used by the visitor to the Site, and the domain name of the visitor’s Internet service provider. We also may use third-party cookies to track the total number of visitors to our Site in an aggregate form to allow us to update and improve our Site. We also use third-party cookies to help us figure out which of our web pages visitors stop at and how long they stay there. This helps us keep our Site fresh and interesting to the majority of our visitors. We use these third-party cookies and other tracking technologies to help us deliver content tailored to a visitor’s interests. You may disable cookies generally or set your browser to alert you when cookies are being sent. However, if you disable cookies, it may affect how the Sites appear and/or operate for you.

Types of Cookies

Session - a session cookie exists only when you are reading or navigating the website. Upon closing the web browser, these cookies are usually removed.

Persistent - a persistent cookie exists on your computer until a future date; for instance, the cookie expiry date could set as 1 year, and each time a website is accessed over this period, our website will access this cookie.

Third Party - these are implemented by third party websites with the aim of collecting certain information to carry out various research into behavioral, demographic and other analytical information, which we use to deliver the best possible user experience.

How do we use third-party cookies and other third-party tracking technologies

Google Analytics and Google AdWords

The Site uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google uses cookies to analyze your use of the Site. The information collected by these cookies about your use of the Site (including your IP address) is transmitted to and stored on a Google server. Google uses this information to assess your use of the Site, providing reports on data such as how often you visit the Site, what pages you view when you visit the Site, and what other websites you have visited prior to visiting our Sites. Google may transfer this information to third parties, if required by law or if third parties process the information on behalf of Google.

To opt out of being tracked by Google Analytics, you may be able to download and install the Google Analytics Opt-out Browser Add-on.

We also use Google AdwordsAdWords Cookies help to make our advertising more effective. Without cookies, it’s harder for us to reach our audience, or to know how many ads were shown and how many clicks they received.

Google may use cookies for a number of purposes, such as to stop you from seeing the same ad over and over again, to detect and stop click fraud, and to show ads that are likely to be more relevant (such as ads based on websites you have visited).

Google store a record of the ads it serves in its logs. These server logs typically include your web request, IP address, browser type, browser language, the date and time of your request, and one or more cookies that may uniquely identify your browser. Google stores this data for a number of reasons, the most important of which are to improve its services and to maintain the security of its systems. Google anonymizes this log data by removing part of the IP address (after 9 months) and cookie information (after 18 months).

Klaviyo Marketing Platform

We use Klaviyo's Marketing Platform to improve the efficiency of our marketing efforts. Klaviyo uses cookies, which are placed on your browser to ensure secure and optimal delivery of our web and email information and services. View Klaviyo's cookie notice.

Klaviyo tracks visitors and prospect activities on our website and landing pages by setting cookies on your browsers and uses a web beacon to track email opens and click-through activity. View Klaviyo's privacy center.

Amazon Seller Central

We use Amazon Seller Central to enhance our marketing on Amazon.com. This service is operated by Amazon Services LLC, a subsidiary of Amazon.com. As such, it is subject to the general privacy policy of Amazon.com, which is available here. In its policy, Amazon says that it is not in the business of selling personal information to third parties. In using Amazon Seller Central, we do not provide information about you to Amazon.com.

Amazon Seller Central may use cookies and similar technologies to recognize you when you visit our Service. The cookies may be used to serve advertising through the website and/or App and/or platform. We and they may use information about your visits to Amazon’s website in order to provide relevant advertisements about goods and services that you may be interested in. We and they may also employ technology to measure the effectiveness of ad.

7.    HOW DO WE PROTECT YOUR PERSONAL INFORMATION?

We follow commercially accepted industry standards to protect the personal information submitted to or collected by us, both during transmission and once we receive it. While we strive to use commercially acceptable means to protect your personal information, no method of transmission over the internet, or method of electronic storage, is 100% secure and we cannot guarantee its absolute security. In the event of an inadvertent disclosure of your personal information, we will take all commercially reasonable steps to limit and remedy the disclosure as required by the applicable law. In light of the foregoing, your use and access of the Service is at your own risk. 8.    WHERE IS YOUR DATA TRANSFERRED TO AND HOSTED?

We will transfer your personal information to other countries only if and when permitted by our legal bases for collecting and using your personal data to begin with, and only to the countries we are permitted to do so by law. Please be aware that the privacy laws and standards in certain countries may differ from those in your country of residence.

The hosting facilities, servers and central database for the service and Service are located in the United States. If you are accessing the Services or Service from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States by us as data controller and as data processor. By signing up for and using the Service you agree to this transfer.

9.    CAN CHILDREN USE THE SERVICE?

The Service is intended for the use of users who are at least 18 years of age. The Service is not directed to persons under the age of 18. We do not knowingly collect or solicit information from, market to or accept services from persons under the age of 18 years old. If we become aware that a person under the age of 18 has provided us with personal information, we will take steps to remove such personal information.

10.    HOW FAR DOES OUR RESPONSIBILITY EXTEND?

This Privacy Policy applies to the Service that is owned and operated by us. The Service and our communications to you may contain links to other third-party sites that may offer products or services that our users might find useful. These third-party sites may request information from you. In such instances, the collection and use of your personal information will be governed by the privacy policy applicable to that third party site. We do not and cannot control the privacy policies, contents or links that appear on these third-party sites. We encourage you to review the privacy policies of any third-party sites or services before providing any of them with your personal information. We accept no responsibility or liability for other third-party sites or services.

11.    HOW CAN YOU ACCESS OR AMEND YOUR PERSONAL INFORMATION (RIGHT OF OPT-OUT, ACCESS AND CORRECTION)?

You may have the right to view, correct, complete or remove your personal information. We will make all reasonable efforts to accommodate requests to o view, correct, complete or remove your personal information unless it is required by law or for any lawful business purpose, and always will delete any personal information that we are required by applicable law to delete at your request.

Your rights to view, correct, complete or remove your personal information your personal information is not absolute. We may deny you such rights when required by law or if the request would likely reveal personal information about a third party. Upon and subject to verification of your identity, we will respond to requests to view, correct, complete or remove your personal information within a reasonable time.

To opt-out, view, correct, complete or remove your personal information, you should submit a written request to us via our Contact Us page. In the case of a request to opt-out of an email list, you may also use any presented opt-out feature in the footer of the email.

12.    HOW CAN I OPT-OUT OF MOBILE MESSAGING?

As a current or prospective customer, you understand that you can text us STOP at any time to opt out of receiving SMS text messages from us at any time. You can text us HELP at any time to receive help.

For support or assistance with opting out, you should submit a written request to us via our Contact Us page.

We may change any short code or telephone number we use to operate the Services at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

13.    YOUR CALIFORNIA PRIVACY RIGHTS

Under the California Consumer Privacy Act of 2018 (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”), California residents have certain rights relating to collection, use, and sharing of their personal information for companies that do a minimum amount of business in or with California residents.

We currently do not meet the minimum necessary requirements to be subject to the CCPA. However, we also do not sell your personal information and will not do so in the future without providing you with notice and an opportunity to opt-out of such sale if required by law. Similarly, we do not offer financial incentives associated with our collection, use, or disclosure of your personal information.

Separate from the CCPA and CPRA, California’s Shine the Light law (California Civil Code Section 1798.83) gives California residents the right to ask companies what personal information (as that term is defined in Section 1798.83) they share with third parties for those third parties’ direct marketing purposes. We do not disclose your personal information to third parties for the purpose of directly marketing their goods or services to you unless you request such disclosure. To the extent that the cookies and web beacons we use to track your interaction with the Service, customize our Service for you, and to collect certain information and data related to your use of the Service, as set forth in this Privacy Policy above, are deemed to be “pen registers” under Section 638.51 of the California Invasion of Privacy Act, by agreeing to this Privacy Policy and using the Services, you provide us with consent to use such cookies and web beacons.

14.    DO NOT TRACK SIGNALS.

We do not currently take actions to respond to “Do Not Track” (DNT) signals because a uniform technological standard has not yet been developed. We continue to review new technologies and may adopt a DNT standard once one is created. For information about DNT, please visit: www.allaboutdnt.org.

15.    CAN UNITED KINGDOM OR EUROPEAN USERS USE THE SERVICE?

If you are located in the European Economic Area (“EEA”) or the United Kingdom (“UK”), you may also have certain rights under the General Data Protection Regulation (“GDPR”) and the UK implementation of the same (“UK GDPR”). Personal information that you provide to us as described in this Privacy Policy is only collected with your consent, and may be transmitted outside of the EEA or UK to us (or computer servers maintained for our benefit) pursuant to that consent.

In general, under the GDPR or UK GDPR, you may:

(a)    request access to your personal information;

(b)    have incomplete or incorrect data corrected;

(c)    have your personal information deleted;

(d)    suspend or restrict our use of your personal information, or withdraw your consent;

(e)    request a copy of your personal information; and,

(f)    complain to a supervisory authority if you believe your rights under the GDPR or UK GDPR are not being respected.

Should you request a copy of your personal information, we will supply to you a copy of it. The first copy will be provided free of charge, but additional copies may be subject to a reasonable fee. Should you request the deletion of your personal information, we will generally do so as soon as practicable, although your right to have your personal information deleted is subject to exceptions, such as, for example, compliance with a legal obligation or for the establishment, exercise or defense of legal claims.  

If you consider that our processing of your personal information infringes data protection laws, you have a legal right to lodge a complaint with a supervisory authority responsible for data protection. You may do so in the EU member state of your habitual residence, your place of work or the place of the alleged infringement, or the UK.

Note that, if you are in the EEA or UK, we may transfer your personal information outside of the EEA or UK, including to the United States. By way of example, this may happen if your personal information is transferred to our servers located in a country outside of the EEA or UK. These countries may not have similar data protection laws to the EEA or UK. By submitting your personal information, you’re agreeing to this transfer, storing or processing. If we transfer your information outside of the EEA or UK in this way, we will take steps to ensure that appropriate security measures are taken with the aim of ensuring that your privacy rights continue to be protected as outlined in this policy.

16.    CAN THIS PRIVACY POLICY BE MODIFIED?

Each time you use or access the Service, the current version of the Privacy Policy will apply. Accordingly, when you use the Service, you should check the date of this Privacy Policy (which appears at the top of the Privacy Policy) and review any changes since the last version. We will occasionally update this Privacy Policy to reflect changes in our Service and/or business practices. You are encouraged to check regularly for any changes to this Privacy Policy. Unless stated otherwise, our current Privacy Policy applies to all information that we have about you. We will not materially change our policies and practices to make them less protective of user information collected in the past without the consent of affected users. 17.    WHAT LAW APPLIES TO THIS PRIVACY POLICY?

This Privacy Policy is governed by the laws of the State of California, without giving effect to any principles of conflict of law. If you are outside of the United States, your information will be processed and stored in the United States, and you consent to such processing and storage under the laws of the United States.
